TERMS OF SERVICE

Please read before commissioning Cat to make anything for you. Before payment and work begins, you agree to everything in the TOS below.

Client = You, the person commissioning mePayment
All prices are listed in USD and payments are issued via PayPal or Venmo invoice. Artist requires the Client to make upfront payment of at least 50% of invoice before any work begins. Client is responsible for paying any transaction fees that are attached to invoice.Artist will provide Client with invoice which will include the following:
a. Type of commission(s)
b. Price of each commission and/or bundle.
c. Transaction/PayPal feesClient will not receive final piece(s) until payment for entire invoice is 100% paid in full. Artist will only provide final pieces at full resolution without watermarks upon fully paid invoice.Commissions are not refundable.Rush Orders
If Client needs work done in a hurry and provides a deadline, Client may secure a spot at the front of the queue for 150% of the commission cost + fees up front.This does not mean Artist will halt all other responsibilities outside of commissions, or halt work on other commissions currently in progress. Process: sketch > flat color > revisions > line work > color fill > shading > final
Client and artist will have open communication throughout the process. Artist will provide watermarked low resolution works in progress (WIP) to client for approval. Watermark removed only once invoice 100% paid.Video Editing _{(aka highlight reels, raid videos, channel trailers, YouTube shorts, Instagram reels, TikToks)}
There may be a flat fee for small and/or common projects. Any special projects requiring more communication, time, and expertise may be charged by the hour. Longer videos will cost more. Client is responsible for providing all source material and assets to be used in video edits. If artist needs to search for video assets, that will add to cost. Client is responsible for acquiring the legal rights and/or licenses to use images, videos, and music that are to be used in edits. Client is responsible for paying any legal repercussions if copyright violations are issued on the commissioned work.If working with Twitch content, Artist may need the "edtior" role on Twitch for easy access to download Past Broadcasts, Clips, access to the highlighter tool and associated stream markers/timestamps. Especially if there is an ongoing need for editing work. Client may remove said editor role from Artist upon completion of the work or termination of the contract.Artist may retain downloaded assets for 3 months after completion of the video commission, at which point assets will be deleted. If 3rd party assets were used that are not contractually exclusive to the commissioned work paid by Client, then 3rd party assets may be reused in other projects for other Clients.Communication
Artist prefers to communicate with clients through Discord DM's. (catavery#1111) but will occasionally need to email things such as large files to Client and vice versa. ([email protected])Artist works on commissions on Part-Time hours. There are times when Artist will not be able to respond right away, such as sleeping or working. Please be patient and allow a few hours for Artist to respond when it's not during work hours.Copyright/Licensing/Usage
Artist will retain rights to all work unless Client purchases full rights at additional cost. Emotes are to be used only on live stream platforms (Twitch, YouTube, Trovo, etc), on personal or brand discord servers, and social media. Client shall not use emotes for commercial use such as reprinting for merch unless commercial license is paid for by client.Under NO circumstances is anything I make to be used as an NFT or to be traded on the NFT market. If anyone suspects that my artwork has been stolen and/or resold without my permission, contact me IMMEDIATELY.Attribution
While not required it is common courtesy to credit artists who did your commissioned works. Providing credit is extremely helpful and encouraged to help artists gain more clients. Many of our paid opportunities are provided through word of mouth.There is now the Artist Badge and Emote attribution features on Twitch which may also be utilized to provide accreditation.Please add a link to this portfolio or my Twitch page in one of your Twitch panels and/or description of your YouTube video.

Artist may choose to display works made for any Clients on their portfolio to use as examples of commissions for others to view. Artist chooses what completed works to display or remove from portfolio at any time at Artist's discretion (unless there are NDA's in effect.
